The Committees of Correspondence

This message was sent out on the evening of December 16, 2004.

With the exception of Zell Miller, who was the keynote speaker at the Republican Convention, every Democratic Senator has been contacted in writing regarding Ohio. But today was just the first pass. The second will seek objections to the Florida Electors. The third will seek objections to the Ohio and Florida Electors. Then the phone calls will begin. After that, moderate Republican Senators will be approached. The same process will be followed in regard to the House of Representatives. And, as tedious as all of this may seem, it is necessary in order to win: A majority is needed in both Houses. And what is at stake is nothing less than the future of the Constitution as a meaningful document.

As you know, Representative John Conyers and a number of his colleagues on the House Judiciary Committee are looking into the Ohio election situation. What they have uncovered is of such serious concern that objections must be made to the Ohio Electors on January 6, 2005. Please exercise your right to do so under the Electoral Count Act of 1887.

The Borg would have us believe "Resistance is futile." Yet we must reply, "Persistence is essential."

With the self-styled mainstream press ignoring election fraud, it is up to us to bring our fellow citizens into awareness so that there may be an awakening and an answer to the call for action. And, whenever doubt enters your mind, look at that national treasure called the Declaration of Independence. Remember, when the Continental Congress issued our country's birth certificate, the smart money was not on the United States of America.

Each of us can make a difference. We must make a difference. And, in recent days, some degree of progress has been made.

On December 8, Representative John Conyers had a briefing on the Ohio situation for the Democratic members of the House Judiciary Committee. Earlier, he had laid out the cause for concern in two letters to J. Kenneth Blackwell, the Ohio Secretary of State. But Blackwell did not appear at the briefing. On December 10, Secretary Blackwell ordered Carole Garman, the Director of the Greene County Board of Elections, to literally take back election records from the staff of the two minor party candidates who asked for the recount--and are paying for it. The claim was made that "...they are not considered public records." Such action is a violation of Sections 3503.26 and 3599.161 of Ohio election law. Section 3599.42 addresses the significance of such conduct: "A violation of any provision of Title XXXV of the Revised Code constitutes a prima facie case of election fraud within the purview of such Title." On December 13, Representative John Conyers will hold a 2004 election forum in Columbus, Ohio. He will be joined by Representatives Maxine Waters, Stephanie Tubbs Jones, and Ted Strickland. No one is expecting Secretary of State J. Kenneth Blackwell.

December 13 is a key date. The Electoral College meets. The Ohio recount begins, as does the countdown to January 6, which is the day Congress meets in joint session to count the electoral votes.

Between now and then, we must do two things: First, request that Representative Conyers send a detailed letter of inquiry to Florida Secretary of State Glenda Hood.* Second, contact your Representative and your two Senators and urge them to object to the Ohio and Florida Electors. In This Corner...Ellen Mariani

My friend, Ellen, called today. We talked for a good while. So much has changed and so much remains the same. And so, it is necessary to reprint this piece, which originally appeared on Rense. com on February 10, 2004. She extends her appreciation to everyone.

For some time, 9-1-1 has meant help. Since September 11, 2001, 9/11 means the Republic is in danger. And the heroes answering that call are not only police, firefighters, and emergency medical personnel. They are ordinary citizens--people like you and me.

Ellen Mariani lost her husband in the Twin Towers tragedy, one of over 3,000 who perished in New York, Washington, or Pennsylvania on that day of infamy. Neil's death was a staggering blow, and vicious shots followed in the form of unanswered questions:

(1) Why were intelligence warnings not heeded?
(2) How did the skyjackers get through security?
(3) Why were fighters not scrambled immediately?

It is absolutely essential that the Breakfast and Brunch Briefings, which raise serious questions about the election, be widely circulated. The self-styled mainstream press is not going to be a player until critical mass is reached. Then they, particularly the networks, will have "an exclusive."

If the tally changes in either Ohio or Florida, the gang loses. The occupation of Washington will be over.

The gentleman from Texas wants us to forget about what happened on the second of last month. While Election Day has come and gone, we must remember that the story has only just begun.

According to State and Federal law, a 1972 United States Supreme Court ruling, and the Constitution, the process is not over. There is a case before a Judge of the Ohio Supreme Court. After that, there will be a recount, which Secretary of State J. Kenneth Blackwell, the chairman of the Texan's campaign in Ohio, wants to put off. For, on December 13, the Electoral College meets and, with the Texan supposedly ahead, the Electors from the Buckeye State will vote for him. And that is the reason for the delay, which is why some are calling him Katherine Harris Blackwell. On January 6, 2005, Congress meets in joint session to count the electoral votes, as required by the Constitution. Under the Electoral Count Act of 1887, if one Representative and one Senator objects, the members must return to their respective Houses and make a decision. If the Senate and House of Representatives reject a State's electoral votes, they are not counted.

At minimum, challenges need to be made to the votes of Ohio and Florida. If there has not been a complete recount in Ohio before December 13, there must be objections. If there has not been a complete recount in Florida or a review of the machines and the documents signed by all officials on Election Day or the following day, there must be objections. On January 6, 2001, members of the Black Caucus, all of them Representatives, objected to Florida's electoral votes. Because no Senator did so, the proceedings in joint session continued, and the members of the Black Caucus walked out--alone. But things must be different this time. They will not be, though, unless we make it so by urging all Democratic Senators and Representatives to object and be prepared to walk out.
