The Order Stands

“I do solemnly swear that I will faithfully execute the Office of President of the United States, and will to the best of my ability, preserve, protect and defend the Constitution of the United States.”  (Article II, Section 1, Clause 8) 


Although it is said “Perception is reality in politics,” the fact remains truth or consequences is a game while truth and consequences is life.  Yet the song and dance goes on between the idea of a republic and the reality of its execution.  For those enamored of titles, finery, and pomp and circumstance ignore intangibles.  But in a republic, leadership depends upon trust.

     Apparently, affirmative action is fine as long as it affirms the actions of certain people.  Then DEI means Don’t Even Inquire.  And the biggest beneficiary is the gentleman from New York. 

     After the election, there was no concession.  Instead, the loser filed 62 cases—and lost.  In response to that failure, he violated Section 3 of the Fourteenth Amendment in plain sight on January 6, 2021. 

     In the spring of this year, the biggest beneficiary of affirmative action was on Meet the Press. 

     “…(D)on’t you need to uphold the Constitution of the United States…?” 

     “I don’t know.  I have to respond by saying, again, I have brilliant lawyers that work for me….” 

     The Constitution is “the supreme law of the land”—and the acts of the three branches “shall be made in pursuance thereof.”  (Article VI, Clause 2)  But the rule of law will be at risk as long as someone illegitimate is in the White House.  For unlike Henry II, in regard to Becket, Uncle Sam has been unable to utter “Will no one rid me of this troublesome pest?”  And there have been missed opportunities in the Electoral College, during impeachment, and certification.

     “The US Constitution protects incompetence,” according to Simon Tisdall of The Guardian.  On this side of the pond, it is said that the gentleman from New York “exposes a Constitution with severe defects.”  (Daily Kos, 03-22-2025)  The critics, foreign and domestic, find it easier to cast aspersions than to look in the mirror or take a moment for reflection.  The problem is not the Constitution, it is cowardice and the fact that some are hypnotized by habit.  The biggest beneficiary of affirmative action does not know if he needs to follow the supreme law of the land—and the press questions the Constitution instead of him. 

     Checks and balances cannot survive an audit when the Judges fail “to do their duty as faithful guardians of the Constitution.”  (Alexander Hamilton, The Federalist Papers, No. 78)  “Where there is a right, there is a remedy” is a basic principle of Anglo-American jurisprudence—as acknowledged by William Blackstone, James Madison, and Chief Justice John Marshall—that is ignored by six on the Supreme Court whenever convenient.  But they allow the current occupant of 1600 Pennsylvania Avenue to act with impunity.  That—and a lack of adequate congressional oversight—is corrosive. 

     As Alexander Hamilton noted, “…(L)iberty can have nothing to fear from the judiciary alone, but would have every thing to fear from its union with either of the other departments; that as all the effects of such a union must ensue from a dependence of the former on the latter, notwithstanding a nominal and apparent separation....”  (The Federalist Papers, No. 78; emphasis added)  Thus, intersection or union makes the branch that is the least dangerous “during good behavior” the most dangerous with lifetime tenure.  For then Judges provide the final gloss on the coffin of the Republic.

“The accumulation of all powers, legislative, executive, and judiciary in the same hands, whether of one, a few, or many, and whether hereditary, self-appointed, or elective, may justly be pronounced the very definition of tyranny.”  (James Madison, The Federalist Papers, No. 47) 

     Failure to face the truth is not without consequences, as the gang posing as a government—WH-13—proves day after day after day.  So, rather than chasing every hare-raising story down a rabid hole, it would be better to follow sage advice:  “An ounce of prevention is worth a pound of cure.”  Then every ridiculous pardon, policy, and appointment can be invalidated by the constitutional remedy to remove the illegitimate. 

     Section 3 of the Fourteenth Amendment makes explicit what was implicit.  That provision prohibits anyone who has taken an oath to support the Constitution and then “engaged in insurrection or rebellion against the same” from holding Federal or State office.  (Emphasis added)  One cannot serve unless “Congress...by a vote of two-thirds of each House, remove such disability.” 

     The Constitution and cowardice are incompatible.  Thus, one must be faithful to the oath.  Stand up and be counted when it matters.

Thanks Marvin. I'm sorry it has taken me so long to explore this blog. Four Potlucks! History does set a precedent. Why does it then repeat itself? Could it be because we are human and our species craves power and control? No doubt one man does.
